Estructura burocrática y Administración Pública

      Se recoja explícitamente en las leyes o no, la jerarquía es un principio estructurador de toda Administración Pública en cualquier tiempo. Es el elemento más característico de la burocracia que cabe identificarlo con la «dominación legal» sociológica de Max Weber. De ahí la concomitancia necesaria entre burocracia y jerarquía. Como antecedente normativo mediato, fue recogido por la Ley de Régimen Jurídico de la Administración del Estado de 1957. Plasmado en la CE de 1978 y otras normas de organización hasta la últimamente publicada Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Púbico. La burocracia no ha recibido críticas amables. Ha sido denostada por todos, pero nadie ha ofrecido un sistema de organización alternativo que pueda sustituirla. Por descontada su vigencia, el concepto burocrático impermeable al medio está siendo sustituido por otro en donde la eficiencia y no la orden jerárquica per se sea el fundamento del sistema. Y en donde el elemento humano sea algo más que un simple número de registro personal.

As Mediate legal background, it was picked up by the Law on Legal Regime of the State Administration of 1957. enshrined in the Constitution of 1978 and other rules of organization to the recently published Law 40/2015, of October 1, on the Legal Regime Pubic Sector. The bureaucracy has not received friendly criticism. He has been reviled by everyone, but no one has offered an alternative system of organization that can replace it. For granted its validity, waterproof bureaucratic concept to the environment is being replaced by another where efficiency and not per hierarchical order the foundation of the system is. And where the human element is more than a simple personal registration number.
